assignaciaкак я писал раньше, вместо одного товара мне пытались подсунуть другой..
После тех письменных перепалок с продавцом, я подал на апелляцию в так называемый SquareTrade - что-то вроде мирового судьи.
Вот что он нам предложил в виде компромисса:
The following proposed settlement agreement is awaiting your review and acceptance. The other party has not yet signed it either.
The terms of the settlement are not binding and do not begin until both you and the other party have accepted the agreement.
------SETTLEMENT AGREEMENT------
dmitry tyumentsev and J.M. Kwastel hereby agree as follows:
1. Seller and Buyer agree to cancel the transaction,
2. to the removal of the following feedback (and any associated response):
Relating to eBay transaction #3530634630
Feedback left for cookiesdiecast by tetiatania
Comment Date: Jun-30-2003 21:07:31 PDT
Comment Type: Complaint
Comment Text: BEWARE! USER IS A SCAM! HE SHIPS YOU CHEAPER STUFF AND CHARGES YOUR CARD!
Response Text: Buyer refused item as described; NEVER charged card; Buyer wants more than bid!!
Followup Text:
and that neither party shall leave any other negative or neutral feedback for any transaction between the parties that occurred prior to the date of this agreement, and should either party do so, this agreement authorizes SquareTrade to have that feedback removed.
Both parties agree that the terms of this settlement agreement will be fully completed by 7/6/03. Provided that both parties have signed this agreement, SquareTrade will notify eBay on 7/6/03 to remove this feedback. If the other terms of the agreement are not completed as expected, both parties understand that one of them must notify SquareTrade by email at fbcancel@squaretrade.com prior to 7/6/03 in order to halt the feedback removal. Removal can take up to 14 business days after 7/6/03.
In consideration of accepting this agreement, each party releases the other party from all liability for claims and/or demands which may arise from the transaction which is the subject of this agreement.
Finally, both parties acknowledge that they have voluntarily entered into this settlement agreement and that this writing constitutes the entire agreement between the parties pertaining to the subject matter contained in it.
Please state whether you accept this resolution. If you and the other party both accept it, it will be a binding agreement. Type your name into the text field that corresponds to your choice. If you represent another entity please add "on behalf of" and indicate who you represent.
Ну вообщем, я согласился с предложением разойтись с миром. Потому как мне я все арвно уже купил все что мне нужно было и без этого упрямого лоха. Посмотрим теперь захочет ли примириться продавец. В любом случае он потрепал себе нервы и потратил лишнее время и деньги. И все - только из-за того что человек упрям до безобразия и не хочет выполнять собственные обязательства...
